Who may qualify

You may qualify if you are a living person in the United States whose personal information was in the files affected by the MOVEit incident — in practice, if Ernst & Young sent you a notice. Filing online requires the Claimant ID and PIN printed on that notice, so this is not a settlement anyone can walk up and file. The “no documentation” option waives proof of your losses, not proof that you were notified.

What the settlement pays

You choose one of two options: reimbursement of documented ordinary losses up to $2,500 plus documented extraordinary losses up to $10,000, or a flat alternative cash payment of $100 with no documentation. Either is subject to pro rata increase or decrease depending on how many valid claims come in. Every class member may also claim two years of identity-theft protection.

What happened

Between May 27 and May 31, 2023, attackers exploited a vulnerability in the MOVEit file-transfer software that Ernst & Young used to handle Bank of America customer data, exposing personal information. EY and Bank of America deny wrongdoing but agreed to pay $2,500,000 to settle the claims against them (Morris v. Progress Software Corporation et al., No. 1:24-cv-11807-ADB, D. Mass.). Claims against Progress Software, which licenses MOVEit, are not resolved and that litigation continues.
