Who may qualify

You may qualify if you paid, in whole or in part, for one or more prescription drugs from Kroger using your insurance at any point from December 9, 2018 through August 23, 2026. “Kroger” includes every pharmacy it owns or operates — the administrator publishes the full pharmacy list. No documentation is needed unless the total you claim is $8,000 or more, though the administrator may still ask for records later; people Kroger's own files already identify are treated as “known claimants” with lighter requirements.

What the settlement pays

The net settlement fund is split pro rata: your share is what you paid during the class period divided by what everyone who files paid, multiplied by the fund. The administrator publishes no per-person figure — the amount depends on how much you and everyone else spent, and on how many people file. Attorneys' fees of up to one third, costs and service awards come out of the fund first.

What happened

A lawsuit alleged Kroger inflated insured customers' prescription copays by reporting its regular retail prices as its “usual and customary” prices to insurers instead of the lower prices available through its Rx Savings Club. Kroger denies wrongdoing and maintains it reported its prices correctly, but agreed to pay $17,000,000 to resolve the claims (Kirkbride et al. v. The Kroger Co., No. 2:21-cv-00022, S.D. Ohio). The court has preliminarily approved the settlement.
